Terms of Service

These Terms of Service govern access to and use of the BookByOnline platform. By creating an account or using the service you agree to these Terms. Merchants are also subject to our Partner Terms, and everyone must follow our Acceptable Use Policy.

Definitions

“We”, “us”, “BookByOnline” means the platform operator. “You” means the person or entity using the service. “Merchant”, “Customer”, “Content” and “Booking” have their ordinary meanings in the context of an appointment-booking platform.

Eligibility

You must be at least 18 (or the age of majority where you live) and able to form a binding contract. If you use the service for an organisation, you confirm you are authorised to bind that organisation to these Terms.

Account creation & authentication

You must provide accurate information and keep it current. You are responsible for your account, credentials and any activity under it. We support email, one-time codes and third-party sign-in; keep your login secure and enable two-factor authentication where available.

Acceptable use

You agree to use the service lawfully and in line with our Acceptable Use Policy. You must not disrupt the Platform, misuse messaging, or infringe others' rights. We may remove content or restrict features that breach these Terms.

Booking services

The Platform lets Merchants publish booking pages and Customers request appointments. A booking is a contract between the Customer and the Merchant; BookByOnline is not a party to it and does not provide the underlying services.

Merchant, Customer & platform responsibilities

Merchants are responsible for their listings, pricing, availability, service delivery and customer communications. Customers are responsible for accurate booking details and honouring their appointments. We are responsible for providing the Platform with reasonable skill and care as described in these Terms.

Platform availability

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, update features, or suspend parts of the service for security or legal reasons. Where practical we provide advance notice of planned downtime.

Marketplace disclaimer

Any directory or marketplace features list Merchants for discovery only. We do not endorse, vet the quality of, or guarantee any Merchant or their services, and are not responsible for interactions or transactions between Merchants and Customers.

Reviews and ratings

Reviews must reflect genuine experiences. Fake, incentivised, defamatory or manipulated reviews are prohibited. We may moderate, remove or reinstate reviews, and Merchants may publicly respond, but must not retaliate against reviewers.

Payments, subscriptions & fees

Paid plans and features are billed in advance on a recurring basis unless stated otherwise. Payment-processing is handled by our providers (e.g. Stripe) and subject to their terms. Fees, taxes and any usage charges are as shown at purchase; you authorise us to charge your payment method for amounts due.

Refunds & cancellations

Except where required by law, subscription fees are non-refundable once a billing period begins. Customer-facing cancellation, deposit and no-show rules for bookings are set by each Merchant and shown at the time of booking.

AI features

AI Receptionist and related features are provided subject to our AI Terms. AI output may be inaccurate and should not be solely relied upon; Merchants remain responsible for their customer interactions and for any required recording/transcription notices and consents.

Intellectual property & content ownership

We and our licensors own the Platform, its software, trademarks and design. You retain ownership of content you upload; you grant us a limited licence to host and process it to provide the service. You must not use our brand assets without permission.

Restrictions

You must not reverse engineer, decompile or attempt to extract source code; scrape or bulk-harvest data; probe, disrupt or bypass security; use the service for illegal purposes; or send spam. These restrictions are essential to protecting the Platform and its users.

Suspension & termination

You may stop using the service at any time. We may suspend or terminate access for breach of these Terms, risk to the Platform or other users, non-payment, or where required by law. On termination your right to use the service ends; certain provisions survive.

Limitation of liability

To the maximum extent permitted by law, the service is provided “as is”; we exclude implied warranties and are not liable for indirect or consequential loss. Our total liability for any claim is limited to the fees you paid to us in the 12 months before the claim. Nothing limits liability that cannot be limited by law.

Indemnification

You will indemnify and hold us harmless from claims, losses and expenses arising from your content, your use of the service, your breach of these Terms, or your violation of law or third-party rights.

Force majeure

Neither party is liable for delays or failures caused by events beyond reasonable control, including outages of third-party infrastructure, natural events, war, or governmental action.

Governing law & disputes

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, unless a mandatory consumer law in your country provides otherwise. We encourage you to contact us first to resolve any dispute informally.
